How we look after your personal information.

About Rare TV

Rare TV is an independent television production company based in London that makes a broad range of prime-time popular factual and specialist factual entertainment programmes for UK, American and European broadcasters. Our main office is at 20 Bakers Row, Farringdon, EC1R 3DG.

This privacy notice explains how we process the personal data of applicants, participants or contributors (including anyone nominated by another to participate) who we are considering, or have decided, to include in a programme which we intend to produce, and of anyone filmed for our programmes.

For the purposes of this notice, “personal data” is any information about an identifiable living person. “Processing” is doing anything with data including collecting, holding, disclosing or deleting it.

Your information is very important to us and we will look after it in line with privacy and data protection laws. We are committed to keeping your information secure with appropriate technical and organisational measures to ensure its confidentiality, integrity and availability.

This policy explains what data we collect, why we collect it, how we use it and who we share it with, as well as your rights as a data subject under data protection law.

Why do we collect personal information?

We collect and process personal information for a number of reasons including:

  • running our business effectively and lawfully;
  • as part of and in connection with our television programme-making and other activities;
  • contacting people about taking part in our television programmes and assessing their suitability to take part;
  • producing, exhibiting, exploiting, broadcasting, distributing, publicising, advertising and promoting our television programmes by any media throughout the world; and
  • responding to queries from members of the public.

What personal information will we collect and why?

We will, are likely, or may process the following information about you in connection with our television programmes which we may obtain from you or from others:

  • Your name, gender, age and date of birth, address and contact details such as your email address and telephone number, your handwriting, and other basic details about you such as the details of your emergency contact and next of kin. We need this information to correspond with you, to contract with you and for administrative and other purposes.
  • Your image, gender, age and birth date, as well as information in your passport, driving licence or other official documents which identify you. We need this information to check your identity and to ensure compliance with relevant laws and regulations.
  • Information about your past and present personal, home and family life, including information about the composition of your family and your other close relationships. We need this information to be able to assess your suitability to take part in our television programmes and to comply with our contractual and regulatory obligations.
  • Information about your past and present professional life including information about your current role and work schedule, your previous work history, your qualifications and your experiences. We need this information for administrative purposes, to be able to assess your suitability to take part in our television programmes and to comply with our contractual and regulatory obligations.
  • Whether you consent or object to being identified in our television programmes and, if you object, the basis of your objection. We need this information to assess your suitability to take part in our programmes and to comply with our contractual and regulatory obligations.
  • Information about you on social media and the internet including your image and voice, the social media accounts you hold and information about you that is online. We need this information to verify your identity and to assess your suitability to take part in our television programmes.
  • Information about your physical and mental health. We need this information to assess your suitability to take part in our television programmes, to make adjustments to our filming arrangements to accommodate any disability you may have, and for compliance with contractual obligations we have to third parties who are subject to statutory regulation.
  • Information about any criminal convictions or cautions you may have and any other criminal activity you may have been suspected of or involved in, and information concerning the nature and status of any arrests, charges, prosecutions, court proceedings or other interactions between you and the authorities including the police. We need this information to assess your suitability to take part in our television programmes, and for compliance with contractual obligations we have to third parties who are subject to statutory regulation.
  • Your age, gender, gender identity, ethnicity, disability and sexual orientation. We will use this information for diversity analysis and monitoring.
  • Financial information, e.g. your bank details and the details of payments made to you. We may need this information to make payments to you and to comply with accounting and tax reporting requirements.
  • Any and all personal information revealed on camera and contained within footage filmed for our television programmes (or given to us by someone else in connection with our programmes) including your image and voice and potentially a wide range of personal information relating to you revealed by you and others, including without limitation: Your name; gender; age and date of birth; address and contact details; information about your past and present personal, home and family life including the composition of your family and other close relationships; information about your past and present professional life including your current role such as your position and work schedule, your previous work history, your qualifications and your experiences; and the details of any legal claim made by or against you and enforcement action taken against you or on your behalf. Information about your racial and ethnic origin, political opinions, religious or philosophical beliefs, your membership of a trade union, your health and any medical treatment you receive, your sex life or your sexual orientation (“special category data”). Information about any criminal convictions or cautions you may have and any other criminal activity you may have been suspected of or involved in; information concerning the nature and status of any arrests, charges, prosecutions, court proceedings or other interactions between you and the authorities including the police (“criminal convictions and offences data”).

We may need this information for editorial reasons and for the production of our television programmes, for contractual reasons and obligations we have to third parties, and to comply with our obligations to you pursuant to our contract with you.

The following refers to the types of personal information set out in the numbered paragraphs above and lists the lawful bases we rely upon to process these types of data.

  • In addition, following exploitation of programmes containing this information, such information may be information manifestly made public by you and, if so, we will rely on the relevant provisions of the DPA 2018 for any further processing of that information.

Legitimate interests

Where we rely on 'legitimate interests' as the lawful basis for processing your data, this includes our legitimate interests to produce and exploit television programmes in the UK and around the world.

We only process data on this legal basis where we have considered that, on balance, our legitimate interests are not overridden by your interests, fundamental rights or freedoms.

The special purposes — public interest journalism

The GDPR and DPA 2018 state that in certain circumstances we do not have to comply with some aspects of data protection law (including this privacy notice) if we believe that doing so would be 'incompatible' with journalism and/or artistic purposes (i.e. it would stop us from doing our job as a television programme maker), data is being held with a view to publication, and there is a public interest in broadcasting the programme. This is known as the 'special purposes exemption'.

Where we are producing certain programmes, we may process your personal data under the special purposes exemption. References above to 'processing undertaken in connection with public interest journalism' include processing where we rely upon the special purposes exemption.

Sharing your personal information

Your personal information is processed by our employees and staff. Sometimes we use third parties who are contractually engaged to provide services to us that may involve the sharing of personal information, e.g. IT services, legal, accountancy and payroll services. We also may need to share your personal information with other organisations from time to time including with:

  • companies involved with our business activities, e.g. broadcasters, post-production houses, sales agents, distributors;
  • broadcasting regulators, e.g. Ofcom;
  • the police or other regulatory bodies as required by law in connection with the investigation of crimes.

Although we are based in the UK, our business is global which means that we may need to transfer your personal information outside the European Economic Area (EEA), e.g. where we have a foreign server storage provider.

If you feature in one of our television programmes, information about you in the programme may be transferred out of the EEA for programme broadcast, distribution and marketing purposes.

If we do this, we will ensure that adequate safeguards are in place to ensure the safety and security of your personal information and that it is processed in accordance with this Privacy Notice.

How we store your personal information

We have implemented appropriate measures to ensure that your personal information is kept safe and secure, e.g. by keeping electronic data on secure servers and hard drives with appropriate levels of security including encryption and firewalls.

We will only keep your personal information for as long as we need to.

Any development projects that are more than two years old will be audited and unnecessary data will be securely disposed of after that time.

For those participating in our programmes, we are likely to retain your information for as long as we need it in order to produce, exhibit, exploit, distribute, advertise, publicise and promote the programme in accordance with our legitimate interests and legal obligations. Broadcasting agreements can be 'in perpetuity', which means we will need to keep electronic files indefinitely.

All production folders and all electronic copies will be stored securely for seven years. After this time, we will conduct a data audit and securely dispose of any data we no longer need to retain.

Your rights

You have a number of rights in respect of your personal information, including the right to object to and/or restrict our processing of your personal data.

You also have the right to request:

  • access to the personal information that we hold about you (e.g. by making a Subject Access Request);
  • that we do not process your personal information for direct marketing purposes;
  • that inaccurate personal information we hold about you is corrected;
  • that personal information is deleted;
  • that your personal information is provided to you in a portable format.

Note that most of these rights are not absolute and are limited to certain defined circumstances. Accordingly, we may not be able to comply with any such request.

If the basis of our processing of your personal information is 'consent', you have the right to withdraw your consent at any time by contacting us using the contact details in this privacy notice. However, note that your data may be being processed subject to another lawful basis as set out above.
